The 2024 TransRockies Race Entry Giveaway

Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN.

1. Promotion Description: The TransRockies Race Entry Giveaway (“Giveaway“) begins on June 25, 2024, at 12:00 am Eastern Standard Time and ends on July 9, 2024, at 11:59 pm Eastern Standard Time (the “Giveaway Period”).

The sponsor of this Giveaway is OrthoLite (“Sponsor“).

This Giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law.

By participating in the Giveaway, each Entrant (as defined below) unconditionally accepts and agrees to comply with and abide by these official rules (“Official Rules”) and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the overall administration of the Giveaway. Questions, comments, or concerns related to the Giveaway should be directed to Sponsor at trrcontest2024@ortholite.us.

2. Eligibility: The Giveaway is open to legal residents of the United States who are 18 years of age or older at the time of entry (each an “Entrant” and collectively, “Entrants”). Employees of Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members and/or those living in the same household of each are not eligible to participate. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Entries will not be acknowledged except as provided herein.

3. How to Enter: Entry does not require a payment or purchase of any kind. To enter the Giveaway, Entrant must have an Instagram account, which can be created by visiting https://www.instagram.com. By submitting an entry (“Entry” and collectively, “Entries”) on Instagram, Entrant agrees to the terms of use and privacy policy of Instagram. If Entrant is using his or her mobile device to enter, charges, including message and data rates, may apply. Entrants should consult their wireless service provider regarding its pricing plans.

To enter, submit a comment on the OrthoLite Giveaway Instagram post that states “#OrthoLiteTRREntry” at instagram.com/ortholitefoam and follow the accounts of both OrthoLite (instagram.com/ortholitefoam) and TransRockies Race Series (instagram.com/transrockiesraceseries).

ALTERNATIVE METHOD OF ENTRY: In lieu of an Instagram submission, you may enter the Giveaway by sending an email with the subject line “2024 OrthoLite/TransRockies Race Giveaway” that includes your full name, email address, daytime phone number, and residential address to  trrcontest2024@ortholite.us.

Limit one (1) Entry per eligible Entrant for the duration of the Giveaway Period. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent these Official Rules. Entries must fulfill all Giveaway requirements, as specified, to be eligible to win a prize. Entries submitted via fraudulent methods, including Entries generated by script, macro, or other automated means, are void. Entries that are illegible, garbled, incomplete, or contain errors are void. Entries that do not adhere to the rules or specifications may be disqualified at the sole discretion of the Sponsor. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. All Entries become the property of the Sponsor.

ELIGIBLE ENTRANTS MUST SUBMIT THE REQUESTED ENTRY INFORMATION IN ACCORDANCE WITH THESE OFFICIAL RULES.  NO OTHER METHOD OF SUBMISSION WILL BE ACCEPTED.

4. Prize: The winner of the Giveaway (“Winner”) will receive the following prize (“Prize”):

Limit one (1) prize per Entrant and per household. No cash or other Prize substitution shall be permitted except at the Sponsor’s discretion. The Prize is non-transferable. Any and all Prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Winner. Winner responsible for all costs associated with travel accommodations and arrangements. No substitution of Prize or transfer/assignment of Prize to others or request for the cash equivalent by Winner is permitted. Acceptance of Prize constitutes permission for Sponsor to use Winner’s name, likeness, and Entry for purposes of advertising and trade without further compensation unless prohibited by law. If a Winner cannot accept a prize, or any portion thereof, as stated, the Prize may be forfeited at the sole discretion of Sponsor. If a Prize cannot be awarded due to circumstances beyond the control of Sponsor, a substitute prize of equal or greater retail value may be awarded, in Sponsor’s sole discretion. The value of the Prize listed above represents Sponsor’s good faith determination of the maximum retail value thereof. That determination is final and binding and cannot be appealed. If the actual value of the Prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety, or performance of any Prize awarded. Sponsor will not replace any lost or stolen Prize items.  No refunds or credit for changes are allowed.

5. Winner Selection: Sponsor is solely responsible for the collection and processing of Entries. Within approximately one (1 ) day of the end of the Giveaway Period, Winner will be selected via a random drawing conducted by Sponsor from among all eligible Entries received throughout the Giveaway Period. The odds of winning will vary depending on the number of eligible Entries received.

6. Winner Notification: Within eight (8) days following the random drawing, Winner will be notified by email and/or telephone, at Sponsor’s sole discretion, using the contact information provided at the time of entry. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s) or telephone numbers, related technical difficulties, failure to adequately monitor email account(s) or voicemail boxes, failure to receive notices due to spam, junk e-mail, or other security settings, or for Winner’s provision of incorrect or otherwise non-functioning contact information.

Notified potential Winner(s) will be required to respond (as directed) to the notification within five (5) days (or a shorter time if required by exigencies) of attempted notification. The failure to respond within the stated time period may result in forfeiture of the Prize.  Potential Winner(s) may be required to verify, address, sign, and return an affidavit of eligibility and release of liability, and, unless prohibited by law, a publicity release and other legal documents as may be required by Sponsor in its sole discretion (collectively, the “Prize Claim Documents“). Failure to return the Prize Claim Documents within the specified time period may result in forfeiture of the Prize and selection of an alternate Potential Winner from the remaining eligible Entries. Sponsor reserves the right to disqualify anyone not fully complying with the Official Rules.

Winner(s) will be solely responsible for all federal, state and/or local taxes, fees, and surcharges (if applicable), including fees or costs associated with the Prize they receive, as well as the reporting consequences thereof.  Other restrictions, conditions, and limitations may apply. Receipt by Winner of the Prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations.

ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE GIVEAWAY, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

7. Rights Granted by You: Winner(s) expressly agree that Sponsor shall be allowed to disclose the winner’s name (first initial, last name), city, and state in response to requests for identification of the winner(s). Further, by submitting an Entry, Entrant understands and agrees that Sponsor, anyone acting on behalf of Sponsor, and Sponsor’s licensees, successors, and assigns shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your Entry, name, portrait, picture, voice, likeness, image, statements about the Giveaway, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. Entrant shall have no right to any compensation, notice, or approval in connection with any such use.

8. Terms & Conditions: Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should any virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such case, Sponsor may select the Winner from all eligible Entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway violates these Official Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void Entries for any reason, including, but not limited to: multiple Entries from the same user from different Instagram accounts and/or IP addresses; multiple Entries from the same computer in excess of that allowed by Giveaway rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an Entrant to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek damages to the fullest extent permitted by law.

9. Limitation of Liability: By participating in this Giveaway, each Entrant agrees to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such Entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error in the administration of the Giveaway or the processing of Entries.

10. Disputes: THIS GIVEAWAY IS GOVERNED BY THE LAWS OF THE UNITED STATES AND COLORADO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, Entrant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Colorado having jurisdiction. Further, in any such dispute, under no circumstances shall Entrant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than the entrant’s actual out-of-pocket expenses (i.e., costs associated with entering this Giveaway). Entrant further waives all rights to have damages multiplied or increased.

11. Privacy: Information submitted with an Entry is subject to the privacy policy stated on Sponsor’s website (“Privacy Policy”). By entering the Giveaway, Entrant grants Sponsor permission to share Entrant’s email address and any other personally identifiable information, including information and/or materials provided at the time of entry, with necessary parties for the purpose of administration and Prize fulfillment or as otherwise outlined herein and/or in Sponsor’s Privacy Policy.

Requests for the names of Winner(s) must be received no later than one (1) year after the Giveaway Period has ended.
